Subject:  SAVA STRATA COMMERCIAL INSURANCE POLICY AND IMPACT OF FBD TEST CASE

Zavarovalnica Sava (“Sava”) fully appreciates the difficult circumstances many of our customers find themselves in as a result of the COVID-19 crisis and we are writing to you to explain the cover that is available under Sava’s Strata Commercial Insurance Policy and update you on our position following recent developments. 

The Sava Strata commercial insurance policy only provides cover for business interruption where there has been an interruption or interference to the policyholder’s business as a result of damage to the insured premises caused by any of the specified contingencies in the policy.
 
We have been closely following all updates and developments in relation to COVID-19 claims, including all legal developments, and considering the impact on our customers’ claims. 

We have considered the recent judgment of the Irish High Court in a test case relating to business interruption insurance taken against FBD Insurance PLC by a number of policyholders (the “FBD Test Case”). The clauses considered in the FBD Test Case were entirely different to the Sava Strata commercial insurance policy and the findings on coverage in that case do not apply to the Sava Strata commercial insurance policy policy.  Unlike the Sava Strata commercial insurance policy, the policy wording in the FBD Test Case did not require property damage for business interruption cover to be triggered.
